Terms of Service

These Terms of Service govern your use of the Watts Market customer and employee apps, our customer credit and loyalty programs, and related SMS notifications, all operated by Watts Market, located at 801 Watts Drive, Bakersfield, California 93307 (“Watts Market,” “we,” “our,” “us”). By creating an account, accepting employment, or using any of our services, you agree to these Terms.

You must be at least 18 years old to create a customer account or to receive SMS messages from us. You also represent that the information you provide is accurate and that you are authorized to use the phone number you provide.

You are responsible for keeping your account credentials (PIN or password) secret and for any activity that happens under your account. Tell us right away if you believe your account has been accessed without permission. We may suspend or close an account that we reasonably believe is being misused, used fraudulently, or shared without authorization.

When you opt in to SMS, either by checking the consent box during customer signup or by being verified as a Watts Market employee in our internal system, you agree to receive recurring text messages to the phone number you provided. Message types include:

  • For customers: account updates, loyalty rewards, special offers and promotions, order and pickup alerts, and store news.
  • For employees: shift assignments, task reminders, bonus and payroll notifications, and urgent store alerts.

Message frequency varies and is typically one to five messages per recipient per week. Message and data rates may apply and are charged by your wireless carrier, not by us.

You can opt out at any time by replying STOP to any message. Reply HELP to receive our contact phone number. You can also disable SMS from within the customer app (Profile → Notifications) or, for employees, by asking a manager. Opting out of SMS does not close your account or stop in-app or email notifications.

Carriers (such as AT&T, T-Mobile, and Verizon) are not liable for delayed or undelivered messages.

The Watts Market customer credit program lets approved customers carry a balance for in-store purchases. Approval is at the discretion of store management. Balances are due as outlined at the time of approval. The loyalty program (rewards and loyalty bonuses) is offered at our discretion and may be changed or ended without notice. We will not retroactively reverse rewards that were already earned and applied to your account.

You agree not to:

  • Use the service in any unlawful way or for any unlawful purpose.
  • Attempt to access another person’s account or any non-public part of our systems.
  • Interfere with, disrupt, or attempt to disrupt the service or our infrastructure.
  • Use automated tools to scrape, copy, or harvest content from our app.

Employees of Watts Market who use the internal admin or employee app do so as part of their employment. The app may collect time-card data, approximate location at clock events, audit records of admin actions, and other operational data. Use of the app is subject to the rules and policies of Watts Market and applicable California labor law.

Our services are provided as is and as available, without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or perfectly secure. You use the service at your own risk.

To the maximum extent permitted by law, Watts Market is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of your use of the service. Our total liability for any claim arising from these Terms is limited to one hundred dollars ($100) or the amounts you paid us in the twelve months before the claim, whichever is greater.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts of Kern County, California.

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top. Material changes will be communicated in-app or by SMS to opted-in users. Continued use of the service after a change means you accept the updated Terms.
